1. About Catlike and the Polisport Group

Founded in Spain in 1996 and acquired by the Polisport Group in 2020, CATLIKE is a brand specializing in the design, development and production of high-performance cycling helmets and accessories. The Polisport Group, founded in 1978 and based in Carregosa, Oliveira de Azeméis, currently includes the companies Polisport, Polinter, Polisport Molds, as well as the brands Catlike, Bobike, Polisport Off-Road and Polisport Driven by Emotion.

It is a fundamental commitment of the Polisport Group to protect the privacy of the personal data of the respective holders and their rights, acting in accordance with the provisions of the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council), in force since May 25, 2018, and Law No. 58/2019, of August 8, which ensures the implementation, in the national legal order, of that Regulation.

2. About this Privacy Policy

This Privacy Policy is intended to inform our clients and consumers about the personal data we collect, how we process it, the specific purposes for which we use it and the rights you enjoy as a data subject.

Protecting your privacy and your personal data is our goal, which is why we treat your data in a fair and transparent manner, ensuring confidentiality and security with regard to the information we request from you, which is only used for the purposes expressly determined herein and which you have consented to

4. What data do we collect and how?

Personal data is information that makes it possible to identify, directly or indirectly, a natural person (personal data subject), in particular by reference to an identifier, such as a name, an identification number, location data, preferences, among others. We only collect information that is strictly necessary and relevant to the purposes for which it is intended. We may therefore collect the following data: full name, telephone number, email address, address (delivery address and tax address, if different), date of birth, tax identification number and payment details that appear on the product purchase invoice. We collect personal data when you interact with us, namely when you purchase products through this website, when you fill in contact and complaint forms, when you subscribe to the newsletter and when you contact us through social networks. We can also collect them from our distributors as part of our complaints handling.

5. For what purposes do we process data?

We process the personal data you provide for the following specific purposes:

  1. Compra, troca ou devolução de produtos – tratamos os dados com a finalidade de proceder ao tratamento da encomenda e expedição da mesma, bem como para tratar a troca ou devolução do produto adquirido.
  2. Para processamento de pedidos de informação e reclamações e propostas de melhoria e/ou sugestão de novo produto – tratamos os dados com a finalidade de responder aos pedidos de informação e às reclamações que nos apresenta, bem como para oferecer feedback às suas propostas.
  3. Newsletters – tratamos os dados com a finalidade de lhe enviar regularmente todas as novidades do Mundo Polisport.

6. What are the data retention periods?

We process and store your personal data in accordance with the specific purposes for which it was collected and processed and only for the period of time necessary to fulfill those purposes. Thus, the retention periods for personal data, according to each processing purpose, are as follows:

  1. Compra, troca ou devolução de produtos – pelo tempo estritamente necessário ao tratamento da encomenda, da troca ou da devolução.
  2. Para processamento de pedidos de informação e reclamações e propostas de melhoria e/ou sugestão de novo produto – 1 ano, desde o primeiro contacto por parte do titular
  3. Newsletters – os dados serão conservados até indicação em sentido contrário por parte do titular. Cada Newsletter inclui um link para que, a qualquer momento, o titular possa remover a sua subscrição.

7. To whom do we pass on personal data?

We only pass on your personal data to third parties as part of the after-sales service, to respond to requests for information or complaints, in two specific cases: to the transport company, if it is necessary to send products; to the local distributor, who is carefully selected by us, in order to speed up the process and resolve the issue. Without prejudice, you should consult the Privacy Policy of the specific transport company or local distributor.

9. What rights does the data subject have?

The holder of personal data has the following rights, among others:

– Right of access to your personal data, as well as to obtain confirmation as to whether or not it is being processed, and to other information, such as the purposes of the processing;

– Right of rectification – you can request the rectification of inaccurate, outdated or incomplete data;

– Right to erasure of data (“right to be forgotten”) – you can request that your data be erased and it is our obligation to erase it whenever it is no longer necessary for the purpose for which it was collected and when you withdraw your consent or object to the processing and there are no legitimate interests justifying it;

– Right to restriction of processing – in certain situations, you can request that we suspend processing (for example, if you dispute the accuracy of personal data, processing will be restricted for a period that allows us to verify its accuracy);

– Right to object to processing – you can object to your data being processed for reasons relating to your particular situation. You can also object to the processing of data for direct marketing purposes, in which case the data will immediately cease to be processed for this purpose;

– Right to data portability – you can request that the personal data you have provided be delivered to you in a structured, commonly used and machine-readable format. You can also request that we transmit your data directly to another entity, whenever this is technically possible.

Data subjects also have the right to withdraw their consent to the processing of their personal data at any time. If you withdraw your consent, your data will no longer be processed, but the withdrawal of consent does not compromise the lawfulness of the processing of personal data that has been carried out up to that date on the basis of the consent previously given.

We will respond as soon as possible, without undue delay and within a maximum of one month from the date of receipt of the request.

10. Security of personal data

We treat the personal data you provide us with a focus on security and integrity, in order to protect them from accidental or unlawful destruction, loss or damage and from unauthorized disclosure or access. To this end, the Polisport Group regularly carries out security audits of its IT infrastructure.
Any breach of personal data that may entail a high risk to your rights and freedoms will be notified to the competent supervisory authority upon becoming aware of it.

11. Limitation of liability (use and risk)

The Polisport Group cannot be held liable for any losses or damages, in terms of civil liability, that result from the incorrect use of the website and its contents by the user, access to the user’s computer and computer system by third parties, viruses, among others. Although the Polisport Group is committed to the security of the website and has put in place the appropriate technical, physical and logical protection measures to ensure its protection, it cannot guarantee or declare that the files available for download are free of viruses, worms, Trojan horses, scripts or any other code or program containing destructive or harmful properties. We therefore warn you to take every precaution to protect your personal data while using the Internet, namely by changing your passwords frequently and ensuring that you use a browser that allows the use of SSL communication.
