The User acknowledges and consents that all intellectual property rights, including but not limited to copyright, trademark, designs, trade secrets or any other rights in the materials or content that are provided as part of the website are, at all times, the property of the Polisport Group or whoever has granted the licence for their use. The User may only use such material in the manner expressly authorised by us or by whoever has granted us the licence to use it.

These Conditions do not grant the User any rights to use any brands and/or logos as well as designs, or other rights protected by copyright, belonging to or licensed to the Polisport Group.

The User shall not copy, translate, disassemble or decompile, or create or attempt to create, by reverse engineering or otherwise, the source code and/or object of the Website, and shall also refrain from removing any confidentiality or intellectual property notices from the Website.

The Polisport Group guarantees that, to the best of its knowledge and belief, it does not infringe any intellectual property rights of third parties.

VIRUSES, PIRACY AND OTHER COMPUTER ATTACKS

The User shall not misuse this website by intentionally introducing viruses, Trojan horses, spyware, malware, or any other technologically harmful or damaging material. The User shall not attempt to gain unauthorised access to this website, to the server where this page is hosted or to any server, computer or database related to our website. The User undertakes not to attack the website in any way, in particular by means of a denial-of-service attack or a distributed denial-of-service attack.

Failure to comply with this clause may imply the commission of various offences provided for and punishable under personal data protection legislation and cybercrime law, which will be duly reported to the competent authorities.

LINKS FROM OUR WEBSITE

If our website contains links to other pages and materials from third parties, these links are provided for information purposes only, without us having any control over or responsibility for the content of those pages or materials, as well as their policies and/or practices. The establishment of links to other websites does not in any way imply the existence of relations between the Polisport Group and the owner or manager of the website to which the link refers. WRITTEN COMMUNICATION

By using this website, the User accepts that most notifications exchanged with the Polisport Group are electronic and that this form of communication fulfils the legal requirement that such notifications be made in writing.

This condition will not affect the rights recognised by law.

REASONS/EVENTS OF FORCE MAJEURE

The Polisport Group shall not be liable for any failure to fulfil or delay in any of the obligations assumed, the cause of which is due to events beyond our control (Force Majeure Reasons/Events).

The concept of Force Majeure shall include any act, event, failure to perform, omission or accident that is beyond our control, including but not limited to the following:

  • General strike, or other forms of protest significantly affecting the country;
  • Disturbance of public order, riot, invasion, terrorist attack or terrorist threat, war (declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, landslide, epidemic or any other natural disaster;
  • Inability to use public or private telecommunications systems;
  • Impossibility of using rail, sea, air, road or other public or private means of transport;
  • Government laws, decrees, regulations or restrictions.

Any obligations shall be suspended during the period in which the Force Majeure Occurs, and the deadlines for the fulfilment of such obligations shall be extended for a period of time equal to the duration of the Force Majeure.

FINAL DISPOSITIONS

Portuguese law shall apply to the conditions of sale presented, without prejudice to other rights recognised to the consumer by the legislation in force.

The Polisport Group has the right to amend these Conditions at any time. The User is subject to the principles and terms in force on the date of their order, unless the law or competent authority imposes any change to them (and such changes apply to orders already placed).

These Conditions, including the Privacy and Cookie Policies, constitute the entire agreement between the User and the Polisport Group regarding the use of the website.

The Policies are an integral part of these Conditions and may not be separated from them.

 

YOU DECLARE THAT YOU HAVE READ AND UNDERSTOOD THESE GENERAL CONDITIONS AND THE POLICIES ASSOCIATED WITH THEM AND THAT YOU HAVE HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE BEFORE ACCEPTING THEM.

YOU FURTHER ACKNOWLEDGE THAT THIS IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND THE POLISPORT GROUP, WHICH SUPERSEDES ANY PREVIOUS PROPOSAL OR AGREEMENT, WRITTEN OR ORAL, AND ANY OTHER COMMUNICATION BETWEEN YOU AND THE POLISPORT GROUP RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
